TERMS OF USE

of the Mayrhofner Bergbahnen AG regarding their Web-TV site

1. Scope of application:
These terms of use shall apply for the WebTV site of the Mayrhofner Bergbahnen AG (hereinafter referred to as "MBB"). The terms of use shall particularly inform the user and govern the contractual relationship between the MBB and the user. The terms of use establish a binding agreement between the user and the MBB concerning the use of services. The terms shall apply to all users of the WebTV site. In order to use the services of the WebTV site, the user has to agree to these terms of use. The user shall not be allowed to use any services if they have not agreed to these terms. By using the services, the user agrees to the terms of use. The user acknowledges that with the use of the services, the MBB considers the terms of use as accepted.

2. Access
The user does not need a WebTV account to be able to watch video clips on the WebTV site; however, for some activities on the WebTV site, such as uploading of video clips, posting of comments, etc., the user needs an account. The user can register and open an account in the "login area". Via the link in the login area, the user can log in. By clicking on the link, the user will be directed to the official YouTube website, where they will be asked to log in with their YouTube or Google user data. The registration is completed by confirming the YouTube information window, which informs the user that the WebTV site is trying to access their profile. The user is not allowed to use the system for any illegal actions such as offending against the YouTube community guidelines, the YouTube terms of service or any other statutory regulations. In any case, the MBB does not accept any liability for any conduct, acts or omissions including those which are not pursued by YouTube.

3. Use of personal data
With the registration, the user acknowledges that the MBB gains access to the user's YouTube profile, including all profile data, information and actions of the user except for the password. The MBB shall be allowed to use these data in order to maintain and improve the WebTV site. In that regard, the user accepts the data protection regulations of YouTube.
All personal data or video contents voluntarily uploaded by the user on the WebTV site (e.g. comments, user profile) can be viewed and used by other persons.
The MBB will not disclose personal data of the user to third parties without the user's consent; however, the MBB can access and disclose personal information, including the content of messages, if this should be necessary to fulfill statutory regulations.
Apart from that, the terms of use or terms of service of YouTube shall apply.

4. Cancellation and deregistration
The user shall have the right to deregister at any time without giving reasons. The deregistration cannot be carried out on the WebTV site but in the user's YouTube account, where the user can deregister the WebTV site access at any time.

5. Court of jurisdiction and applicable law
The legal relationship between the MBB and the user shall exclusively be governed by Austrian law under exclusion of the UN Sales Convention as well as the Rome Convention of 1980. Exclusive court of jurisdiction shall be the regional court Zell am Ziller, Austria - independent of the value in dispute.
